Pricing:
Pricing details are provided to the Customer via email or other written forms. Customers will not be charged unless the service has been completed, unless specified otherwise.
Price Adjustments:
In the event of a price increase, Cam's will provide written notification at least thirty (30) days prior to the new pricing taking effect. Customers may cancel within this 30-day period without incurring cancellation fees or penalties.
Term of Service:
The service term runs annually from April 1st to December 1st. Contracts automatically renew on January 1st each year unless the Customer provides at least seven (7) days' written notice to terminate.
Early Termination:
Cancellation before the renewal date requires payment of a $199 cancellation fee. This fee compensates for preparation costs or lost opportunities, including scheduling conflicts and resource allocation.
Refund Policy:
Cam's is committed to customer satisfaction. Our refund policy is as follows:
Cancellations:
· Cancellations made more than 24 hours before a scheduled service will not incur a fee.
· Cancellations within 24 hours may result in a charge equivalent to 50% of the service cost.
Service Issues:
Customers must report service concerns within 48 hours of the service date for resolution. Cam's will evaluate and, if necessary, provide corrective services or a partial refund.
Refunds are not provided for completed services except under extraordinary circumstances determined by Cam's.
Property Access:
For recurring services, it is the Customer’s responsibility to ensure property access. If parts of the property are inaccessible, Cam's will complete what is available. Customers will be charged for the full service, and Cam's is not responsible for returning to complete inaccessible areas.
Prorating:
When a service starts mid-month, Cam's will adjust the charge accordingly to ensure fair billing. This process, known as prorating, ensures that customers are only billed for the portion of the service period they actually receive.
*For example, if a Customer signs up for mowing services on the 10th of the month, and the monthly fee is $100, the Customer will be charged a prorated amount of $75 for that month (for the 21 days of service received out of a 30-day month).*
Nonpayment:
Failure to make timely payments may result in Cam's pursuing the Customer for the full outstanding amount, along with reasonable attorneys’ fees and related costs. Cam's reserves the right to assign payment rights to a third party if necessary.
*For instance, if a Customer owes $500 for completed services and fails to make a payment within 60 days, Cam's may pursue legal action to recover the outstanding amount, including any additional collection costs or fees.*
Indemnification:
The Customer agrees to indemnify and hold harmless Cam's, its agents, employees, and affiliates against claims or damages arising from the services provided, except in cases of intentional misconduct. This includes, but is not limited to, damage caused by services rendered, breach of contract, or third-party claims related to the services provided.
Insurance and Liability:
Cam's is fully insured. Customers can access relevant insurance documents in the Company Info section of our website.
Force Majeure:
Neither party shall be held liable for any failure or delay in performance due to causes beyond their reasonable control, including but not limited to acts of nature, labor disputes, or government actions.
Dispute Resolution and Mediation:
In the event of a dispute, both parties agree to attempt resolution through mediation before pursuing legal action. The cost of mediation will be shared equally between the parties.
Limitation of Liability:
Cam's liability for any claim arising from the provision of services shall be limited to the total amount paid by the Customer for the service that gave rise to the claim.
Customer Conduct and Cooperation:
The Customer agrees to provide a safe working environment for Cam's staff. If the Customer engages in behavior that hinders the completion of work or poses a risk to the safety of staff, Cam's reserves the right to suspend or terminate services.
Right to Terminate Without Cause:
Cam's reserves the right to terminate the service agreement at any time, with or without cause, by providing written notice to the Customer.
Intellectual Property and Work Ownership:
All designs, plans, and materials created by Cam's remain the property of Cam's unless otherwise agreed upon in writing.
Miscellaneous:
Cam's will send these Terms & Conditions via email. If the Customer does not have an email on file, they will have access to a "Client Portal" to update their account information. It is the Customer's responsibility to ensure they are aware of the terms.
These Terms & Conditions are governed by the laws of Pennsylvania, with disputes to be resolved in the courts of Northampton County, Pennsylvania.
